Terms of Service

These Terms of Service ("Terms") are an agreement between you and Last Mountain Media Co. ("we", "us") for the use of TopHat, our household organizer at mytophat.app. By creating an account or using TopHat, you agree to these Terms. If you don’t agree, please don’t use TopHat.

Who can use TopHat

You must be an adult — at least the age of majority where you live — to create a TopHat account. TopHat is for running your household: adults set it up and are responsible for any information they enter about the children in their home. We don't knowingly let children create their own accounts.

Your account

You're responsible for your account and for keeping your password safe. Give us an email address you actually use — it's how you recover your account and receive anything you ask us to send. Let us know promptly if you suspect someone else has accessed your account.

Your household

TopHat is organized into households. Anyone you invite can see the content shared in that household, and household owners can manage members and settings. Invite thoughtfully — you're responsible for the people you bring into your household and how your household uses TopHat.

Your content

The content you create — tasks, events, notes, lists, recipes, and the rest — is yours. You grant us a limited licence to store, process, and display it solely to operate TopHat for you and your household. We don't sell your content, and we don't use it to train AI models. Our Privacy Policy explains how we handle your information.

Acceptable use

Please use TopHat lawfully and for what it's meant for. Don't:

We may suspend or limit accounts that abuse the service or put other families at risk.

Early access and pricing

TopHat is in early access. Families who join now (“founding families”) get the current features free, and our intention is to keep founding families free as described on our site. We may introduce or change paid plans in the future; we'll give reasonable notice of material pricing changes before they affect you.

Third-party services

Some features connect to third parties — for example Google Calendar (optional sync) and Stripe (payments). Your use of those services is also governed by their own terms, and we aren't responsible for them. You can disconnect an optional integration like Google at any time.

Service availability

We work hard to keep TopHat running and useful, but — especially during early access — it's provided on an “as is” and “as available” basis. We don't promise it will be uninterrupted or error-free, and features may change, be added, or be removed as the product evolves.

Disclaimers and limitation of liability

To the fullest extent permitted by law, TopHat is provided without warranties of any kind, and it isn't a substitute for your own judgment in running your family's affairs. To the fullest extent permitted by law, Last Mountain Media Co. will not be liable for any indirect, incidental, or consequential damages, or for lost data, arising from your use of TopHat. Our total liability for any claim is limited to the amount you paid us for TopHat in the twelve months before the claim (or, if you're on a free plan, CAD $50).

Ending your use

You can stop using TopHat and delete your account at any time. We may suspend or end accounts that break these Terms or that we need to act on to protect the service or other families. When the last member leaves a household, that household's content is removed.

Changes to these Terms

We may update these Terms as TopHat grows. When we do, we'll revise the date above and flag significant changes in the app. Continuing to use TopHat after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada that apply there, without regard to conflict-of-laws rules.
